Negotiations with HMRC

Negotiations with HMRC can take many different forms. Unlike creditors, HMRC can sometimes be more flexible regarding payment options. In the first instance of negotiation with HRMC, there will be the discussion of a Time To Pay Agreement (TTP). A TTP is similar to a Company Voluntary arrangement (CVA) in that the timeframe is often negotiated between the company and HMRC. Instalments will be agreed upon, usually lasting no longer than one year. This option may benefit a company if the outstanding tax is not excessive.

Though a TTP may look good on paper, the difficulty lies in successfully setting it up. A business must be able to stick to the financial arrangements made in a TTP. Some of the options the Boardroom Punks will look to explore include a CVA, administration, and a moratorium. In each of these possible solutions, we will speak directly with the creditors and HMRC to balance debt payment and the survival of your company.

If there is a failure to pursue negotiations with HMRC, this can cause a great deal of distress for a company. As discussed above, if there is no attempt to indicate to HMRC that a company is looking to work toward paying any outstanding debt, then they will instigate methods that will lead to insolvency. The acquisition of assets, property and court proceedings will inevitably cost any director so much money that they will have no option but to declare an enterprise insolvent.
